Declaring Ramadan: Processes Before Positions. Originally written for Islamicate.co.uk, 2016.

Summary

This short paper argues that classical fiqh was more concerned with the correct process for declaring Ramadan than the correct position on when Ramadan should start. The process in question was classically a judicial process, and therefore tied to political authority. In minority settings, Muslims should strive to appoint a representative body to declare the entry of the month. The position that such a body accepts should be treated as binding, whether that position is local sighting, global sighting or following calculations, each of which is supported by classical juristic precedent.
